Terms & Conditions for the Criminal Background Check
The terms set out here govern the Criminal Background Check Service (“the Service”) provided by Truvi Technologies Ltd (“Truvi”) to Hosts. These terms may be amended, modified, or updated from time to time at Truvi’s sole discretion. Any changes will be effective immediately upon posting the revised terms on Truvi’s Platforms. It is the Host’s responsibility to review these terms periodically to stay informed of any updates, and the Host’s continued use of the Service shall be deemed acceptance of any updated terms.
- HOW IT WORKS
1.1. When using Truvi’s Platform or Application Processing Interface (“API”), Hosts can apply the subscribed Service to any qualifying Booking. The qualifying Booking must have Basic Screening applied and the Guest must be a resident within the United States, otherwise the Booking is ineligible for the Service. Additionally, that Booking must be pulled through to the same Platform or API.
1.2. This Service requires Guest interaction via the Guest journey and their explicit consent to the Service. - WHAT IT IS
2.1. The Guest’s information as set out below, collected during their Guest journey and/or Screening, is checked against the US Federal and National Database for crimes in the last seven years across all crime categories. This is a non-comprehensive check, meaning it does not involve a full review of all jurisdictions associated with a Guest’s residential history, due to the absence of a centralised criminal record database in the United States.
2.2. The following Guest details are required to fulfill this Service:
2.2.1. Guest Information:
2.2.1.1. Full Name; and
2.2.1.2. Date of Birth. - STATUS AND FEES
3.1. Following the completion of the Service, the Host will be provided with a status instantly. The status can be:
3.1.1. Approved;
3.1.2. In Review;
3.1.3. Pending; or
3.1.4. Flagged.
3.2. If the Service receives a status of “In Review”, the Guest Services Team will follow up directly with the Host.
3.3. The Fee chargeable per Booking for the Service shall be outlined on Truvi’s Platform and may form part of a fee for a package of Truvi services.
3.4. The Host will be charged for the completed Service at check-in regardless of any cancellation of the Booking that may happen in the interim. A completed Service means that the relevant Guest and subsequently the Booking has been assigned either an “Approved”, “In Review” or “Flagged” status. - HOST OBLIGATIONS
4.1. The Host shall introduce and prominently display the details and the requirement of participation in the Service to Guests in appropriate locations, including by reference to Truvi’s Privacy Policy. These locations may include the property listing itself or the Host’s official website. - LIMITATIONS
5.1. The Service is only available for Guests who are residents in the United States.
5.2. The Service is completed against only the lead Guest and not accompanying guests.
5.3. The Service requires explicit consent from the Guest to be obtained during the Guest Journey. Where a Guest does not consent to the Service, the Guest cannot continue with the Verification and the Host shall not be charged for the Service.
5.4. The Service is an optional upgraded Service for all eligible Bookings where the Basic Screening Service has been applied.
5.5. Truvi shall not be held liable for any damage resulting from errors or omissions in information, instructions, or scripts provided by the Host in connection with the Service. Truvi assumes no responsibility for actions taken at the Host’s discretion.
APPENDIX
INTERPRETATION
- The definitions and rules of interpretation which apply in this agreement:
“Approved” means if the Guest’s information does not match the US Federal and National Database;
“Booking” means a confirmed stay that has been submitted to Truvi;
“Cancelled” means any Bookings which are cancelled before the Guest checks in and subsequently notified to Truvi by the Host;
“Fees” means the charges or costs associated with completed Services;
“Guest” means the lead guest who makes a Booking;
“Host” means an approved accommodation property advertiser who is advertising approved Listings on a recognised STR Platform;
“In Review” means the Guest’s information does match the US Federal and National Database or there was an issue with the Service. The Guest Services team will manually verify the Guest’s additional details against the Registry to confirm if they are a match;
“Pending” means the Guest has not yet attempted this Service;
“Platform” means any digital interface through which Truvi provides its Services;
“Flagged” means the Guest’s submitted details match the US Federal and National Database after review;
“Services” means the Services provided by Truvi to the Client under these terms and as outlined on the Platform;
“Verification” means the protocols and processes performed by Truvi in order to allocate a status to any Booking, can also be referred to as “Screening”.
